Is an ADU Right for You? A Santa Barbara Guide to Accessory Dwelling Units

Update, September 2026: California's ADU rules got even friendlier on January 1, 2026. SB 543 requires cities to confirm an ADU application is complete within 15 business days and exempts units of 750 square feet or less from impact fees (500 square feet or less from school fees). AB 1154 removed the owner-occupancy requirement for junior ADUs that have their own bathroom, though those units must be rented for more than 30 days. AB 462 set a 60-day decision deadline for ADU coastal development permits, which matters for many South Coast properties. As of mid-2026, the City of Santa Barbara had not opted into AB 1033, so ADUs here still can't be sold separately from the main home.

Are you struggling to find a home that fits your budget? Or maybe you could really use some extra income or need a separate space for aging parents or loved ones. If any of that sounds familiar, an accessory dwelling unit (ADU) might be just what you're looking for.

What's an ADU?

An ADU is simply a small, independent living space on the same property as a single-family home. It must have its own entrance, living and sleeping area, kitchen, and bathroom. ADUs can be set up in different ways:

  • A converted space within the main house, such as a basement or attached wing
  • A living space above or in place of a garage
  • A completely separate building in your backyard (even a manufactured home)

California also allows junior ADUs (JADUs) of up to 500 square feet created within the footprint of the existing home.

Why Are ADUs So Popular?

More and more people are discovering the perks of ADUs. In fact, a recent survey found that nearly a quarter of real estate agents say something like a mother-in-law suite is a top feature buyers want right now.

Not only can an ADU provide extra living space, but it can also help you earn extra money by renting it out. Whether you buy a property that already has an ADU or decide to build one, renting it can help cover part of your mortgage. In a high-cost market like Santa Barbara, that rental income can make a real difference.

Other Major Benefits

  • Close but still separate: An ADU is perfect if you want to live close to family or friends but also value having your own private space.
  • Aging in place: If you have older parents who need occasional help, an ADU lets them stay near you while still having their independence.
  • Built-in childcare: If family members live in your ADU, they can often help with childcare, saving you money and giving your kids more time with their grandparents.

Important Things to Know in California

  • Selling separately: Because an ADU is part of a single-family property, it usually can't be sold on its own. A 2023 state law (AB 1033) lets cities and counties opt in to allowing ADUs to be sold separately as condominiums, but each jurisdiction has to adopt it locally.
  • Owner occupancy: State law (AB 976) permanently removed the requirement that the owner live on the property to add a standard ADU.
  • Fees and timelines: Local agencies must act on a complete ADU application within 60 days, and ADUs of 750 square feet or less are exempt from impact fees.
  • No short-term rentals: ADUs must be rented for 30 days or more, so they can't be used as vacation rentals.
  • Coastal and fire zones: Properties in the Coastal Zone need a coastal development permit, and homes in high fire hazard areas may face additional design standards. Check with the City of Santa Barbara or County of Santa Barbara planning department early.
